Proposition 36 Encourages Drug Treatment and Holds Repeat Retail Theft Offenders Accountable

SACRAMENTO, Calif. (July 12, 2024) The League of California Cities (Cal Cities), representing 476 cities and 80% of Californians, have voiced their support of Yes on Proposition 36, the campaign to hold repeat retail theft offenders and serious drug traffickers accountable while incentivizing drug treatment for those with serious addictions. San Diego Mayor Todd Gloria this week also announced his support of Proposition 36 joining other big city mayors from San Francisco, San Jose, Fresno and Santa Monica.

Cal Cities joins the California Contract Cities Association, and over 150 local elected officials and municipalities across the state, including San Diego Mayor Todd Gloria, San Jose Mayor Matt Mahan, San Francisco Mayor London Breed, Fresno Mayor Jerry Dyer and Santa Monica Mayor Phil Brock in voicing their support for Proposition 36.

Proposition 36 is a bipartisan measure focused on improving safety in every community and neighborhood in California – focusing on accountability measures for repeat offenders of theft and drug traffickers of serious drugs like fentanyl while incentivizing and encouraging more individuals to participate in and complete drug treatment programs. The measure creates a deterrent for repeat offenders and redirects some towards treatment rather than incarceration.

Specifically, Proposition 36, the Homelessness, Drug Addiction, and Theft Reduction Act will:

  • Hold those who are committing repeated retail theft and fentanyl sales crimes accountable for the safety and health of our communities.
  • Create accountability for repeat smash-and-grab offenders who are driving up costs for all Californians and chasing retailers out of the state.
  • Bring back incentives and accountability needed for individuals to get into necessary drug treatment and job training programs — helping them begin new lives. Currently, those arrested multiple times for hard drug use have no incentive to choose treatment with no consequences.
